Welcome to the Masarrah App

Global Shaleehat Company LLC in the Sultanate of Oman provides the Masarrah App which operates as an intermediary electronic platform between Hosts who own establishments or any establishments or facilities that the App approves for listing and Tenants wishing to rent them We provide electronic booking services through the App in accordance with the following terms and conditions

First Definitions

In this Agreement unless the context otherwise requires the following terms shall have the meanings assigned to them below

App or we or us or our refers to the Masarrah App and Global Shaleehat Company LLC in the Sultanate of Oman holding Commercial Registration Number 1344621

User or you or your refers to any person who visits or uses the App in any manner whether as a Host Tenant or otherwise

Host refers to any natural or juristic person who registers on the App for the purpose of listing establishments or any establishments or facilities that the App approves for listing and also refers to any person authorized by the Host or deemed as such

Tenant refers to any natural or juristic person who registers on the App for the purpose of renting establishments belonging to Hosts in accordance with the agreement concluded through the App and also refers to any person authorized by the Tenant or deemed as such

Service refers to the service of electronically booking Hosts establishments through the App

Establishment means all units or places displayed through the App for booking or rental purposes including but not limited to establishments chalets hotel apartments villas hotels furnished apartments caravans yachts wedding halls seating areas and camps

Establishment Policy refers to the set of terms and instructions placed or added by the Host under one policy that is announced to the Tenant before submitting a booking request and which includes all provisions relating to the use of the establishment and the cancellation or amendment of bookings

Agreement refers to this document including its terms and conditions the Privacy Policy all other agreements between the App on the one hand and any of its Users on the other hand as well as all instructions and orders issued by the App to any of its Users These agreements shall be complementary to one another

Laws refers to the laws applicable in the Sultanate of Oman

Second Our Services

1 The App provides Hosts with services for listing establishments for electronic booking through the App in accordance with the terms and conditions of this Agreement

2 The App provides electronic payment services and payment methods suitable for all our Users in accordance with the payment policy adopted under this Agreement

3 We provide App services to all Tenants from inside or outside the Sultanate of Oman The App aims to provide a distinguished experience to all citizens and foreigners

Third Legal Scope of the Agreement

1 This Agreement has been prepared by the Masarrah App and is presented through the App for full acceptance without excluding any provisions or rejecting it in its current form If the User does not agree to any of its provisions the User must refrain from using the App or benefiting from its services This Agreement includes all terms and provisions that govern the legal relationship between the App on the one hand and the App Users on the other including any related clauses provisions or contracts

2 You acknowledge that this Agreement constitutes a complete contract with all required terms and elements It has been prepared and drafted in accordance with the laws applicable in the Sultanate and is intended to be accepted and approved electronically It shall produce all its legal effects once accepted and approved in accordance with its provisions It is subject to the general rules set out in the Omani Civil Transactions Law Number 29 of 2013 the Omani Electronic Transactions Law Number 39 of 2025 and any other relevant laws

3 This Agreement shall be effective against all App Users No User may evade their obligations in any manner deny the Agreement or claim rejection of it in contravention of its provisions within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

4 You acknowledge and agree that this Agreement is subject to continuous updates to ensure the optimal regulation of the legal relationship between the App and its Users and that such amendments and updates shall have the same binding legal force as this Agreement

Fourth Host Membership Registration

1 The App allows the Host to register a membership through which the Host may list establishments and any facilities approved by the App for listing through electronic booking via the App Membership provides several features including receiving requests tracking their status communicating with Tenants and other features

2 Host membership registration on the App requires completing the account registration form through the App and providing us with the following data establishment name owner name and identity card owner phone number contact numbers email address Instagram account establishment facilities photos prices establishment location establishment policy and rules and proof of ownership document

3 The App may request any documents or data necessary to verify property ownership the Host eligibility or compliance with applicable regulations including the identity card title deed permit from the Ministry of Heritage and Tourism or any other regulatory permits The Host must provide such documents within the period specified by the App

4 The Host shall obtain all licenses and permits required to conduct the tourist rental activity from the competent authorities in the Sultanate of Oman The Host alone bears full legal responsibility for complying with these requirements and the App may suspend or remove the Establishment in the event of non compliance without any liability on the App

5 If the Host is not the owner of the Establishment the Host must provide proof of the legal right to rent it such as a valid lease contract investment contract express approval for subleasing or a duly approved legal power of attorney The App may request such documents at any time and may suspend or cancel the account if they are not provided

6 The account name must fully reflect the User identity It is prohibited to use misleading fictitious or third party names for the purpose of deception or fraud The membership name may not include the word Masarrah so that other Users do not mistakenly believe that you represent us contrary to the truth and reality

7 Registration of membership on the App is personal in nature This means that you may not claim to have registered on behalf of another person and the App may take recourse against any violator

8 The Host undertakes not to register more than one account on the App If we discover otherwise we will delete all accounts belonging to the Host

9 The Host undertakes to maintain the confidentiality of the account password not to disclose it to others and not to allow any person to use the account The Host shall be fully responsible for all transactions and operations carried out through the account on the App

10 The App may close your account temporarily or permanently without notice if you breach any of the terms and conditions of this Agreement infringe any of our rights or the rights of others violate any applicable laws in this regard or if there is any change or amendment to laws or decisions issued by the competent authority

Fifth Electronic Signature

1 Your use of the App registration of your account through it listing of services through it request to benefit from the services provided by the App or any use of the App in any manner shall constitute final acceptance of this Agreement within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

2 You acknowledge that your signature under paragraph 1 replaces any handwritten signature required on this Agreement and constitutes final approval of the electronic contracting system provided by the App for accepting the contract with the User and implementing the provisions of this Agreement

Sixth Establishment Listing Policy

1 The Host shall provide an accurate description of the Establishments including the establishment name governorate city village neighborhood proximity to public services and facilities exact geographical location photos and any other detailed data about the place

2 Listing Establishments constitutes a binding offer Accordingly the booking request submitted by the Tenant shall constitute a legal acceptance and the App approval and confirmation of the booking shall constitute the formation of the right and the realization of its effects

3 The Masarrah App may display the approximate location of the Establishment within the listing provided that the actual and precise location is shown only after the booking is completed

4 The Host shall apply the announced policy that the Tenant has expressly accepted Any provisions in the Establishment Policy that conflict with this Agreement the terms and conditions Tenant version or the Privacy Policy shall be deemed void

5 If the Host wishes to sign a written contract with the Tenant or an acknowledgment of receipt of the movable items available at the place the Host must state this clearly in the policy and terms of use of the place If it is not stated the electronic booking made through the App shall be sufficient and all data available electronically through the App shall constitute complete evidence of the rental transaction its parties and its subject matter

6 The Host shall provide clear and accurate photos of the Establishments or any facilities approved by the App for listing including external facade photos interior photos and facilities These photos must be continuously updated and must reflect the current condition of the place

7 The Host must enter the correct prices in the App and the App will display them for rent at such prices The owner shall bear all consequences thereof and may not demand a price change after a booking request is received or demand cancellation of the booking as a result The Host shall ensure that the price includes all amounts due from the Host and shall clearly disclose whether the price includes value added tax and any tourist or municipal fees prescribed under the laws applicable in the Sultanate of Oman The Host bears responsibility for the accuracy of such disclosure

8 The Host shall state all contents of the Establishments or any facilities approved by the App for listing and offered for rent so that the Tenant is aware of the items to be received from the Host Such items shall be inventoried and recorded before handover of the place

9 If there are bookings for the Establishments the booking status of those places shall be changed to unavailable booked or maintenance in order to avoid booking conflicts through the App

10 If the Host offers promotions on booking transactions such promotions must have specific terms such as specifying their duration the discount period the Establishments covered by the discount and the times covered by the offers

11 If the Host requires a security deposit before handing over the Establishment the amount of the security deposit and the conditions for entitlement to it or its refund must be disclosed in the Establishment Policy before the booking is completed Receipt and refund of the security deposit shall take place directly between the Host and the Tenant and outside the App payment systems The App shall not be a party to receiving holding or refunding that amount and does not provide any guarantees or undertakings in relation to it This shall be the sole responsibility of the Host and the Tenant

12 The Masarrah App reserves the right to amend or hide the property name or replace it with a marketing name when needed It may also regulate the manner in which the Establishment is displayed within the App including the displayed name description marketing wording and display ranking in accordance with its approved policies and standards This is intended to improve the User experience protect the platform and prevent fraudulent practices at its discretion and without prejudice to any other legal rights and without giving rise to any right for the Host to object or claim compensation

13 The Host agrees that the Masarrah App may display the Establishment and its content on other platforms through electronic linking for the purpose of marketing it and increasing booking opportunities Acceptance of this Agreement constitutes express consent to the same The Host shall also refrain from causing any booking conflict as a result of displaying the Establishment on other platforms

Seventh Host Terms and Conditions

1 Host registration with us is personal in nature Accordingly the Host may not assign the account to others or allow any other Hosts to list their Establishments through it without obtaining our written approval The Host shall be the first and final person responsible for the account linked to the phone number and shall be liable for any unlawful or unauthorized use through the account on the App

2 The Host represents that the Host has obtained all official licenses required to conduct the rental activity and undertakes to provide all papers and documents evidencing the same whenever we deem it appropriate to request them

3 The Host shall comply with the requirements and standards approved by the App for Establishments listed through it undertakes to provide all requirements set out therein and acknowledges under the Host personal responsibility that such requirements are provided by the Host who bears full civil and criminal responsibility for them without any legal liability on the App The Host shall also apply the Host Establishment Policy fairly and lawfully and shall not manipulate its interpretation or construction in any manner within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

4 The Host acknowledges that the Host provides services to the Tenant under the Host personal responsibility without any liability on the Masarrah App and represents that the Host has all legal authority and powers to provide such services The Host shall also fully verify the Tenant identity before handing over the Establishment to the Tenant

5 The Host represents that the Establishments are not subject to any judicial attachment that no judicial receivership orders or other judgments have been issued in relation to them that conflict with the Host right to rent or the Tenant right to use them throughout the agreed period and that the Host guarantees non disturbance by the Host or third parties in a manner that affects the Tenant lawful enjoyment of the Establishment during the agreed period

6 The Host shall continuously update booking availability on the App to avoid any conflict or double booking The Host may receive bookings from outside the App provided that the booked days are immediately closed on the App The Host shall be responsible for any booking conflict resulting from failure to update availability

7 The Host shall provide the services to the Tenant in accordance with the agreement concluded between them without any legal liability on the App and shall hand over and receive the place from the Tenant at the agreed times The Host undertakes to enable the Tenant to benefit from the place during the agreed period not to disturb the Tenant in any manner and to guarantee that third parties do not disturb the Tenant during the Tenant use of the place

8 The Host shall take all safety measures necessary to preserve the safety of Tenants companions and their belongings and not expose them to danger The place must be highly clean and orderly and must comply with any requirements prescribed by the competent authorities in the Sultanate of Oman

9 The Host acknowledges and agrees that the App does not provide any type of insurance or compensation for damages If the Host or any places belonging to the Host suffer any damage or loss the Host may take legal action directly against the Tenant without recourse to us in any manner This clause constitutes a disclaimer of the App liability in this regard within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

10 The Host acknowledges full legal responsibility towards the Tenant other persons and all governmental and non governmental entities in the event of breach of any terms of this Agreement This clause constitutes a disclaimer of the App liability towards third parties

11 The Host acknowledges that we have no employment legal representation agency or other relationship with the Tenant If the Tenant breaches any of the Host rights the Host must take all legal measures independently without recourse to us or against us

12 If you change any data relating to your App account or the places you list through it you must immediately update such data through the App

13 The Host shall treat the Tenant properly and shall not abuse the Tenant The Host shall also refrain from abusing us in any manner or unlawfully or offensively exploiting the App name or the owning entity in a manner that harms us or causes us to face unlawful claims

14 The Host represents that all information data photos names and phone numbers provided through the App are true and shall bear full legal responsibility before the competent authorities if any false misleading or non conforming data is provided

15 The Host represents that the content provided by the Host including photos information and service content is privately owned by the Host and is not subject to any third party intellectual property rights The Host shall bear full legal responsibility towards rights holders without any liability on the App

16 The Host the Host representatives or any other affiliated parties shall be fully responsible for any changes they make in their control panel such as changes to prices offers and otherwise

17 The Host shall be fully responsible for continuously updating the prices of the Establishments and properties belonging to the Host and shall comply with such prices when the Tenant makes a booking

18 The Host shall respond to booking requests within the period specified through the App If the Host fails to respond the Masarrah App may take any measures it deems appropriate including issuing an initial notice a final warning in case of repetition or temporarily or permanently suspending or disabling the account at the App discretion and without prejudice to any other legal rights

19 The Host agrees to provide the App with all documents requested upon demand including personal identification property ownership documents and permits required from the competent authorities

Eighth Booking and Cancellation Policy

1 The Tenant may view establishments or any other activities eligible for rental and available for booking on the App along with their prices then submit an electronic booking request through the App and confirm the request through payment using our approved payment methods Bookings on the Masarrah App are subject to two systems

First Host enabled instant electronic booking If available the Tenant booking is made directly upon booking the available Establishment

Second Host enabled electronic booking after confirmation In this case the Host must confirm or cancel the booking within the time specified by the App

2 The booking date may be amended in accordance with the App policies and the Establishment Policy applicable at the time of the amendment request Any amendment shall be subject to the other party approval and the availability of the requested dates The amendment may also result in price differences or fees according to the prices applicable at the time of amendment

3 The Masarrah App shall deduct a service fee of 2.2 percent of the booking amount The party causing the cancellation shall bear this fee which shall be deducted directly without notice The service fees may change from time to time and the party causing the cancellation shall bear them regardless of their percentage

4 If the booking is cancelled by the Host the App shall impose additional cancellation fees and may deduct such fees from any booking amount paid through us in the future

5 Where the Host accepts the booking and fails to hand over the place to the Tenant in accordance with the agreement concluded through the App and fails to cancel the request in accordance with the cancellation policy the Host shall in such cases pay the full booking amount as compensation to the Tenant

6 If the Host and Tenant agree to amend booking dates they must contact us and provide proof of such agreement

7 The Host shall maintain the accuracy and updating of the Establishment availability and booking data If the Host cancels a confirmed booking without a legitimate reason rejects booking requests without justification or amends booking dates without exceptional circumstances requiring such amendment the Masarrah App may take any measures it deems appropriate in accordance with the penalties and controls set out in the explanatory table below including issuing notices imposing financial fines temporarily suspending the Host account or permanently disabling it without prejudice to any other legal rights of the App or the Tenant

8 The App may take appropriate action if the Host breaches the provisions of this Agreement or the approved policies including notice warning financial fines account suspension account disabling or removal of the Establishment from the App in accordance with the policies and procedures applied by the App

9 The Host may not reject booking requests except for legitimate reasons or exceptional circumstances beyond the Host control Rejection of a booking without a legitimate reason shall be deemed a breach of the platform terms and shall result in application of the penalties prescribed in the explanatory table below and the operational policies approved by the App

First Cancellation of a confirmed booking by the Host

First time
A formal notice is issued to the Host by the App including a cancellation notice and a warning not to repeat the breach

Second time
A financial fine of OMR 10 is imposed with a final warning issued to the Host

Third time
The property account is temporarily suspended for one month and a financial fine of OMR 40 is imposed

Fourth time
The property is removed from the App and permanently disabled

Second Rejection of an unconfirmed booking without a legitimate reason within 30 days

First time
Formal notice

Second time
A financial fine of OMR 10 is imposed with a warning

Third time
A financial fine of OMR 30 is imposed with a warning

More than three times within 30 days
Permanent suspension of the Host account at the discretion of the App management

10 Neither party shall be liable for failure to perform its obligations if such failure results from force majeure or causes beyond its control provided that such cases shall be handled in accordance with the policies approved by the App

11 In emergency events calamities public disasters and wars such as infectious diseases natural disasters or binding governmental orders the App reserves the right to cancel bookings and refund amounts to Tenants Hosts and Tenants shall not have the right to file any legal claims against the App and the parties expressly release us from liability in such case The App may deduct electronic payment service fees bank transfer fees and service fees

12 The User acknowledges that the policies procedures and operational protocols approved by the App including booking cancellation payment refund and fine policies form an integral part of this Agreement and the User shall be bound by them once they are published or updated through the App

13 The Host shall follow up on bookings and requests received through the App and respond to them within the periods specified in the App policies Repeated delay or refusal to respond shall be deemed a breach entitling the App to take appropriate measures in accordance with this Agreement and its approved policies

14 The App may impose fees or fines or take regulatory measures in the event of misuse of the booking date amendment feature or repeated or unjustified amendments in accordance with the operational policies and protocols approved by the App

Ninth Subscription and Payment Policy

1 The App provides subscription packages for Hosts according to the packages available through the App Each package provides different features for Hosts as shown in the package table You acknowledge and agree that the Masarrah App may change package pricing plans at any time Changes shall apply to new subscription periods unless the change relates to governmental fees or taxes in which case the Host shall pay them for the current subscription period

2 The Host must provide a bank account If the Host provides an account with another bank the Host shall bear bank transfer fees and the App may deduct such fees

3 The App transfers booking amounts to Hosts after the customer leaves the Establishment after 10 business days The App may change transfer dates depending on available circumstances and the booking date in the App shall be referred to in order to determine the transfer date

4 The Host may request an advance payment to confirm the booking provided that its amount and conditions are clearly specified in the Establishment Policy The Tenant shall pay it accordingly The App shall not be liable for such advance payment if it is collected outside the platform

5 The App allows the Host to activate the pay on arrival option whereby the booking is made without advance payment through the App and the Tenant shall pay the booking value upon arrival at the Establishment In this case the Host shall collect the amount and transfer the App commission within the specified period

6 If a dispute arises between the Host and the Tenant regarding the booking process handover return or any other dispute the App shall transfer the amounts due to the Host after the dispute with the Tenant is resolved

7 The Masarrah App charges annual fees for updating Establishments in terms of photos and data The amount of such fees depends on various factors including location and others and we will notify the Host of such fees

8 The Host shall comply with all laws regulations and rules applicable in the Sultanate of Oman including the payment of any governmental fees or taxes due without any liability on the App

9 Masarrah provides monthly or annual subscription packages The property owner may not claim any amounts if the owner decides to withdraw from the Masarrah App before the expiry of the term as subscription fees are non refundable If the subscription package is upgraded the property owner shall pay the price difference for the remaining period Subscription fees shall be non refundable in the cases set out in this policy unless the App at its discretion decides to grant a full or partial refund or alternative credit in exceptional cases without prejudice to any rights that may not be waived under the applicable laws

10 If a higher priced package is downgraded to a lower priced package Masarrah shall not be obligated to refund the price difference

11 Package subscription fees shall not be refunded if the cancellation or removal is attributable to the Host breach request or an order issued concerning the Host or the property However if the App terminates the subscription for a reason not attributable to the Host the App may at its discretion refund the proportional part or provide alternative credit unless the law provides otherwise

12 If Masarrah or the Establishment owner decides to delete the property for any valid reason before the Establishment subscription period expires the Establishment owner shall not be entitled to claim any amounts in compensation for the remaining period

13 The Masarrah App allows some Users to pay the booking value through installment payment services provided by external programs such as QPay Tasheel or any other service provider in accordance with the terms and conditions of each program The Tenant acknowledges that any obligation or agreement relating to the installment service is between the Tenant and the service provider only and the Masarrah App shall not bear any liability in this regard

14 The Masarrah App may delete any Establishment from the App if an order or judgment is issued by the competent governmental authorities against the Host or the Host property and subscription amounts for the remaining period shall not be refunded

15 The Host may create discount coupons of the Host own and the Host shall bear the full cost of such coupons The Masarrah App may also create discount coupons at its own expense and the App shall bear their cost The Host shall comply with and accept such coupons when used by Tenants

Tenth Content Policy

1 The Masarrah App provides its own content through the App pages and retains all intellectual property and commercial rights over such content Misuse of this content in any manner is prohibited It is intended only for our services and it is prohibited to copy modify imitate quote or carry out any work on the content without obtaining our written approval

2 The Masarrah App allows its Users to provide content through the App Such content is provided under the User full responsibility The User represents that the content is lawful and does not infringe any intellectual property rights or personal rights of third parties The User shall bear full legal responsibility towards rights holders in the event of breach of any of their rights

3 If notices are submitted to the Masarrah App stating that User provided content infringes any third party right the App will delete such content

4 The Masarrah App may access and monitor all messages conversations and chats conducted through the App and may access any content exchanged between Hosts and Tenants The App processes Users data in accordance with the Privacy Policy published inside the App and for the purposes of account creation booking execution payment technical support legal compliance and fraud prevention User data shall not be used for direct marketing purposes except as permitted by applicable laws and in a manner that allows the User to unsubscribe whenever possible

5 The Masarrah App may use the names photos and data of Establishments or any other activities eligible for rental and registered with us for advertising and promotional purposes pursuant to a non exclusive license granted by the Host to the App to use such content for marketing and promotion purposes throughout the period during which the Establishment is listed The Host may withdraw this license by written notice to the App provided that such withdrawal takes effect within a reasonable period and without retroactive effect on promotional campaigns conducted before the notice All processing of personal data in this context shall be carried out in accordance with the Privacy Policy and the Personal Data Protection Law issued by Royal Decree Number 6 of 2022

6 The Masarrah App may display advertisements inside the App and in any place we deem appropriate The Host shall not be entitled to claim any share of profits or make any other claims

7 The Masarrah App may display any feedback or opinions of Tenants on our platform after booking Establishments and Hosts and Tenants shall not have the right to object to the same

8 The Masarrah App provides an in app chat service The Host may not share contact numbers or any other means of communication with the Tenant through it If this occurs the Masarrah App may take the necessary action

Eleventh Reviews Policy

1 The App disclaims legal liability for all unlawful reviews or reviews that include abuse of any party The author of the review shall bear full legal responsibility

2 The Masarrah App may retrieve and display guest reviews published on other platforms

3 The Tenant may review the stay and the services provided and the Host may not object to such review The Masarrah App may display the review as is amend it or hide it in whole or in part at its discretion without any legal liability on the App towards any party as a result of such reviews within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

Twelfth Trademarks

1 Masarrah and the logos associated with it are our trademarks or service marks Photos logos page headers button icons texts and service names are also trademarks and trade dress belonging to the Masarrah App

2 It is prohibited to reproduce the trademarks or trade dress of the Masarrah App in any media or advertising outlet without our written permission The trademarks and trade dress of the Masarrah App may not be used in connection with any product or service that is not affiliated with us so as not to undermine the value and credibility of the Masarrah App or harm its customers

Thirteenth Legal Liability

1 You expressly agree that you use the Masarrah App at your personal responsibility You acknowledge and agree that the Masarrah App is an intermediary between the Host and the Tenant and does not bear any disputes or legal consequences that may arise between the Host and the Tenant Each party may take appropriate legal action against the other party without recourse to us in any manner within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

2 You shall use the App seriously and honestly and shall be liable to compensate for any losses or damages suffered by the App as a result of any unlawful use or use unauthorized by us

3 The User provides us with the User data through the App under the User personal responsibility Accordingly the User shall bear civil and criminal liability if such data is incorrect incomplete inaccurate forged or non conforming in any manner within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

4 You acknowledge your full legal responsibility if you breach any provisions set out in this Agreement In the event of such breach we may take all measures against you including suspending or cancelling your membership or resorting to the courts

5 You acknowledge your full legal responsibility if you use the Masarrah App or any service provided through it in an unlawful manner or if you send any messages involving racial discrimination insult defamation obscene language indecent or immoral images or content generally deemed inappropriate

6 Each of the Tenant and the Host shall be personally liable for all errors and unlawful activities that occur during the performance of the Service without recourse to the App under any circumstances The relationship between the Tenant and the Host is contractual Accordingly each party shall perform its contractual obligations and if either party breaches them the other party may seek recourse against that party in accordance with the applicable laws without recourse to us under any circumstances within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

7 The injured party that suffers damage as a result of any party breach of this Agreement shall take all necessary legal measures against the perpetrator of the unlawful act without recourse to us or against us The injured party shall notify us of the violation only so that internal App action may be taken such as suspending or permanently banning the membership within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

8 The penalties imposed by the Masarrah App on the parties to this Agreement shall not affect the right of each party to take any legal measures it deems appropriate at its discretion without recourse to us in any manner and without any liability on the App within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

9 You agree to indemnify release and defend the Masarrah App against all lawsuits and claims that may be brought or asserted by third parties as a result of your use of the App your violation of these terms and provisions or your breach of the rights of other Users within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

10 The Masarrah App does not guarantee that it will take action against every violation that may occur under these Terms of Use Our failure to take legal action in any case of violation shall not be deemed a waiver of our right to take such action at any time we deem appropriate

11 You must comply with all laws and regulations applicable within the Sultanate of Oman and you shall bear all liabilities arising if you breach such laws or regulations You shall also comply with all terms and conditions set out in this Agreement

Fourteenth Legal Scope of Our Services

1 The Masarrah App operates as an intermediary electronic platform that enables electronic booking only The App shall not be described as a Host or a Tenant We do not own any of the Establishments nor do we request to rent them for ourselves The listing is made by the Host and the rental by the Tenant Our role is limited to connecting the parties and facilitating the electronic booking process

2 The Masarrah App shall not be deemed an agent or legal representative of any of the parties to this Agreement whether Hosts or Tenants Each person represents themselves through the App

3 All Users whether Hosts or Tenants acknowledge that they use the App at their personal responsibility and without any legal liability on the App whether civil consequential joint or criminal The App shall not accept any legal liability arising from the fault of a third party

Fifteenth Disclaimer of Liability

1 We provide our services as available without any representations or warranties of any kind whether express or implied relating to the use of this App its content or the services provided on it

2 There may be delays in obtaining data or partial or total loss of such data and the Masarrah App shall not be responsible in any manner for loss of data or delay in obtaining it within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

3 The Masarrah App shall not bear any legal liability if the App stops for technical or legal reasons cyber hacking or any other voluntary or involuntary reasons provided that such reasons are beyond its control within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

4 The Masarrah App shall not bear any legal liability in the event of hacking of the App any breach thereof or leakage of User data as a result within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

5 The Masarrah App shall not bear any legal liability if the Host fails to hand over the Establishment to the Tenant or if the Host closes the Establishment or changes the activity despite existing bookings In such case the Tenant may seek appropriate compensation from the Host within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

6 The App shall not in all cases be liable for any direct indirect or consequential loss loss of profits or goodwill or any damage whatsoever resulting from disclosure of your username or password The Masarrah App shall also not be legally responsible for losses or damages of any kind that may arise from use of this App including but not limited to direct and indirect damages within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

7 The Masarrah App does not provide any warranties that this App its servers or messages sent are free from viruses or other harmful components You acknowledge that the Masarrah App is an internet based service and although we make every effort to keep information secure we cannot guarantee that the information received or transmitted by the User while using the App will be secure at all times within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

8 The Masarrah App provides no warranty and assumes no liability regarding the currency prevalence accuracy or quality of information that the User receives or obtains through the App Responsibility for using or relying on information received or obtained by the User through the services of the Masarrah App rests entirely with that User within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

9 The Masarrah App its officers and employees shall not be legally liable to you or to any other party for any direct or indirect loss or any other cost that may arise from or in connection with the implementation of the Terms of Use Agreement or the provision of our services within the limits permitted by law and without prejudice to any liability that may not be excluded under the laws in force in the Sultanate of Oman

Sixteenth Government Taxes

The parties to this Agreement shall pay the taxes imposed on them under the laws applicable in the Sultanate of Oman The App shall not be obligated to pay any taxes or governmental fees on behalf of any of its Users The App may suspend the membership of any User block access to the App or suspend the User activity or transactions if the User breaches this obligation

Seventeenth Assignment of Rights and Obligations

1 The Masarrah App may assign all of its rights and obligations under this Agreement to a third party without requiring the approval of any App User The User shall perform all obligations under this Agreement towards the assignee once notified of the assignment and the assignee may take all legal measures against any party who fails to perform its obligations under this Agreement

2 The User may not assign any rights or obligations under this Agreement or arising as a legal effect thereof except after obtaining the App written approval Any assignment of rights or obligations without the App approval shall be void

Eighteenth Amendments

1 The Masarrah App may change the terms and conditions and Privacy Policy at any time it deems appropriate and for any reason The User must review such amendments before continuing to use the App We will notify the User by appropriate means and we will update the Last Updated date at the top of this document

2 We may at any time make any amendments or improvements we deem necessary to the App and its services to increase their effectiveness Your continued use of the App after any updates to the terms and conditions and Privacy Policy whether by addition deletion or amendment shall constitute your express acceptance of such updates

3 The Masarrah App may change current and future fee subscription and commission plans without requiring the approval of any App User New fee plans shall apply directly from the date they are changed by the App The App may also amend change or suspend any features or services it provides at its discretion

Nineteenth Termination of the Agreement

The Agreement shall be deemed terminated automatically without the need for notice or judicial procedures in any of the following cases if it is established that you have breached any paragraph or clause of this Agreement above while preserving all our rights to claim compensation for resulting damages if you assign the account or sublease it without our approval if the User fails to fulfill any obligations stipulated in this Agreement without taking serious measures to remedy such breach while preserving our right to claim compensation where applicable if we are unable to verify any information you provided to us if we determine at any time that your activities may expose you or other Users to legal disputes if the App activity ceases or if the activity of the persons responsible for managing the App ceases

Twentieth Applicable Law and Competent Courts

1 This Agreement shall be governed by the laws applicable and in force within the Sultanate of Oman

2 The courts within the Sultanate of Oman shall have jurisdiction over any dispute that may arise from the interpretation or implementation of the provisions of this Agreement and the Muscat Court of First Instance shall be competent to hear such dispute

3 If any provision of this Agreement becomes invalid unlawful or unenforceable the legality and enforceability of the remaining provisions shall not be affected in any manner by such provision

Twenty First Communications and Notices

1 You acknowledge and agree that we may contact you on your phone number registered with us electronically via email through in app alerts or by any other means of communication Such communications shall be official between the App on the one hand and the Users on the other

2 You acknowledge and agree that telephone and electronic communications between you and the App shall replace any written notices or notices through official authorities and telephone and electronic communications and notices shall remain the means applicable between the parties

3 Any legal notices alerts or notifications you wish to send to the Masarrah App must be sent through the means specified inside the App Any notices sent outside the App shall not be recognized

4 Any legal notices alerts or notifications that the Masarrah App wishes to send to you shall be made either by posting them on the App or by sending them to you via the phone number or email address you provided during registration or any other contact details belonging to you You shall be deemed to have knowledge of the notice once it is posted on the App or from the time the message is sent to you

Twenty Second Language

1 The Arabic text of this Agreement shall be the approved text for the purposes of interpreting and applying its terms and provisions

2 In the event of any conflict between the Arabic text and the translated text of this Agreement the Arabic text shall prevail

Twenty Third Penalties

In the event of breach of any provision of this Agreement the Masarrah App may take any measures it deems appropriate at its discretion and without prejudice to any penalties or procedures set out in the clauses above including but not limited to

1 Issuing a notice or alert to the User

2 Issuing an initial or final warning in the event of repeated breach

3 Imposing financial fines in accordance with the App policies

4 Temporarily suspending the account

5 Permanently disabling the account

6 Blocking or removing violating content or Establishments

These measures shall not prejudice the App right to take any other legal action or claim compensation for any damages arising from the breach
